Terms of Use

These Terms of Use (the "Terms") govern your use of the DuckWise mobile application and related services (the "Service"), provided by INDARRA LIMITED, a company registered in Cyprus, Floor 2, 82 Akropoleos, Strovolos 2012, Nicosia ("we", "us", the "Company"). Our Privacy Policy forms part of these Terms.

By downloading, installing or using the Service you confirm that you have read and accept these Terms. If you do not accept them, do not use the Service.

1. Eligibility

You may use the Service only if you are of legal age to enter into a binding contract and to invest in your jurisdiction, and only where the Service is lawfully available. The Service is intended for adults.

3. How research is presented

• Producer. All ideas are produced and published by DuckWise Research, operated by INDARRA LIMITED.
• Methodology. Ideas combine technical analysis and fundamental context within a model portfolio, with a capital-preservation-first approach. The methodology, the definition of each field and the way results are measured are described on the Methodology page inside the App, which forms part of these Terms by reference.
• Timing. Each idea shows the date and time it was opened and closed, in US market time (US Eastern). Where an exact time was not recorded, an approximate time is shown to 15-minute precision.
• Meaning of terms. A projection is a forecast — an opinion of where a price may move. It is not a guarantee, a promise of return, or an instruction to trade. A stop level marks the point at which an idea is treated as invalidated.
• Track record. The yearly Rate is the share of ideas closed in that year that finished with a positive result, out of all ideas closed in the same year. An idea counts as positive on any gain, regardless of whether it reached the projection.
• Performance is hypothetical. All performance shown is based on a model portfolio, is hypothetical, and may exclude fees, taxes, spreads and slippage. Past, simulated or back-tested results do not indicate future performance.
• Conflicts of interest. Authors may hold positions in the instruments mentioned in an idea. We disclose this generally rather than per idea.
• Data quality. Prices, quotes and market data may be delayed, incomplete or contain errors.

4. Subscriptions, trial and cancellation

• The Service offers a free trial with full access to analytical content. After the trial, access requires a paid subscription.
• Subscriptions are sold through the Apple App Store. Payment is charged to your Apple Account at confirmation of purchase.
• A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel a subscription at any time in your App Store account settings. Cancelling stops future renewals; it does not shorten the period you have already paid for.
• Purchases and refunds are handled by Apple under Apple's terms. We do not process payments and cannot issue App Store refunds directly.
• Prices and plans may change; changes apply to future periods and never to a period already paid for.

5. Licence and permitted use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial purposes, for as long as you comply with these Terms.

Research content is the core of a paid product. You may not:

• republish, redistribute, resell, broadcast, or share ideas, price targets or the track record with anyone outside your own use, including in channels, chats, groups or paid communities;
• share your account or subscription with another person;
• scrape, crawl, or use automated means to extract content, or access the Service other than through the App;
• copy, modify, decompile, reverse engineer or create derivative works from the Service, except where the law expressly permits it;
• attempt to gain unauthorised access to the Service or its infrastructure, disrupt it, or bypass technical restrictions and entitlement checks;
• use the Service in breach of applicable law, including market abuse and insider dealing rules.

6. Intellectual property

The Service and all content in it — including research ideas, text, methodology, track record data, design, graphics and software — belong to INDARRA LIMITED or its licensors and are protected by intellectual property law. These Terms grant you no ownership of anything.

7. Availability and changes

We may change, suspend or discontinue any part of the Service, and may require you to install updates. We aim to keep the Service available but do not guarantee uninterrupted operation.

8. Termination

You may stop using the Service at any time and cancel your subscription through the App Store. We may suspend or terminate your access if you materially breach these Terms, in particular by redistributing research content or sharing access. Sections 2, 3, 5, 6, 9, 10 and 12 survive termination.

9. Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY IDEA, PROJECTION OR ANALYSIS WILL PROVE CORRECT OR PROFITABLE.

11. Changes to these Terms

We may update these Terms. The current version is always published at tradeasduck.com/terms/ and takes effect when published; the effective date appears at the top. If a change materially affects you, continuing to use the Service after publication means you accept it. Only the English version has legal effect; translations are provided for convenience.

12. Governing law

These Terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus have jurisdiction. If you use the Service as a consumer in the European Union, you keep the protection of the mandatory rules of the country where you live.
